Service Agreement

Table of Contents
This Service Agreement sets out the terms under which Spotless Poop Scoopers (βSpotless,β βwe,β βusβ) provides pet waste removal services to you (βCustomer,β βyouβ). By scheduling service with us β online, by phone, or in person β you agree to be bound by this Agreement.

Section 01: Services Offered
Spotless Poop Scoopers provides residential pet waste removal services in the Fresno, California area. Services are performed on a recurring scheduled basis (weekly, bi-weekly, or as otherwise agreed) at the service address you provide. Spotless and its employees agree to provide services stated in this Agreement in a reliable and trustworthy manner.
We currently offer three service tiers:
- Spotless Essential β Pet waste removal from your yard.
- Spotless Signature β Pet waste removal plus deodorizing treatment.
- Spotless Supreme β Pet waste removal, deodorizing treatment, and targeted repellent spray.
Section 02: Service Tiers and Pricing
Pricing is based on your selected service tier, visit frequency, number of dogs at your property, yard size, and any add-on services. Current pricing is displayed on our website and at the time of booking. Prices are subject to change with 14 days' notice to you.
Price changes: We will notify you of any pricing changes via email or SMS (if you have opted in) at least 14 days before they take effect. Continued use of service after notice constitutes acceptance of the new pricing.
Section 03: Scheduling and Hours of Operation
Spotless Poop Scoopers performs services between dawn and dusk, Monday through Friday. We do not accept time-specific service requests, as we cannot guarantee accurate arrival windows within a specific time of day. You will be assigned a service day based on your location and route availability, and we will notify you of that day when your service begins.
We make every effort to complete service on your assigned day. Occasionally, due to technician scheduling, health issues, or other operational factors, service may need to be rescheduled. When this occurs, we will attempt to provide at least 24 hours' notice.
Section 04: Property Access Requirements
To perform service, our technician must be able to access your yard on your scheduled service day. It is your responsibility to ensure:
- All gates or access points are unlocked and free of obstructions (including dogs, lawn furniture, and padlocks);
- Any gate requiring a key or combination lock has access credentials provided to us in advance. We are not responsible for keys requested to be mailed or held by us. A lockbox or combination lock is the preferred access method where controlled entry is required;
- Dogs are secured inside your home or otherwise prevented from entering the service area during the visit; and
- No aggressive animals are present in the service area.
If our technician cannot safely access your yard on a scheduled service day due to a locked gate, unsecured pet, aggressive animal, or other access issue, you will be charged for that visit and service will not be performed. We will notify you of any access issue and reschedule when possible.
Water Access
Our technicians may need access to an outdoor water spigot to clean equipment or mix sanitizing and deodorizing solutions on-site, particularly following loose stool cleanup. Please ensure outdoor water access is available on your scheduled service day.
Section 05: Pet, Yard, and Vaccination Requirements
Aggressive Animals
Our technicians will work around friendly animals; however, we will not perform service in the presence of aggressive animals. If service cannot be completed safely due to an aggressive animal, you will be notified and charged for the visit.
Yard Conditions
To enable thorough and complete service, you agree to:
- Turn off grass sprinklers on your scheduled service day;
- Maintain grass at a reasonable mowing height so that waste is visible and accessible; and
- Keep the yard reasonably clear of leaves, debris, standing water, or other conditions that would prevent our technician from locating and collecting waste.
Spotless Poop Scoopers is not responsible for waste that cannot be located due to overgrown grass, excessive debris, or other yard conditions outside our control, and our No Pile Left Behind Guarantee does not apply when these conditions exist.
Vaccination Records
You agree to maintain accurate and current vaccination records for all dogs on your property. In the event of a dog bite or attack involving a Spotless employee, or if requested for any other legitimate reason, you agree to make those records available to us promptly.
Section 06: Sanitation and Waste Disposal Standards
Spotless Poop Scoopers is committed to maintaining a safe and sanitary environment for you, your pets, and the community. Our technicians follow these standards on every visit:
- Disinfection: Hands, shoes, and tools are disinfected after each service visit to prevent the spread of disease or pathogens between properties.
- Waste Disposal: All collected waste is bagged and placed in your trash receptacle, unless your service tier includes off-property disposal.
- Equipment Sanitation: Tools are cleaned and sanitized between service calls, including additional cleaning when loose stools or diarrhea are present.
Section 07: Billing and Payment
Billing Cycle
Spotless Poop Scoopers bills on a recurring basis. Payment is due by credit or debit card autopay on the last week of the prior month or on the day service is rendered, as confirmed at sign-up.
Accepted Payment Methods
We accept major credit and debit cards. Payment information is stored securely through our payment processor in compliance with PCI-DSS standards. We do not store your full card number on our systems.
Late or Failed Payments
If a payment fails or is declined, we will notify you and attempt to collect. A late fee of $2.00 per day will accrue on any outstanding balance beginning the day after the payment due date. Service may be paused or suspended if payment is not received within 7 days of the due date. Accounts past due more than 30 days may be referred to a collections process.
Prepayments and Credits
All prepayments are considered earned or to-be-earned at the time of payment. No cash refunds will be issued on prepaid amounts. Prepayments will be applied as account credits toward future services provided by Spotless Poop Scoopers.
Service Credits
If we fail to perform a scheduled service visit and cannot reschedule it within the same service week, you will not be charged for that visit, or if already charged, a credit will be applied to your next invoice.
Section 08: Cancellations, Skips, and Pauses
Canceling Service
You may cancel your service at any time by giving us at least 24 hours' advance notice before your next scheduled service visit. Cancellations received with less than 24 hours' notice will be charged the full visit fee. A $25.00 cancellation fee applies to new account visits cancelled without at least 24 hours' notice.
When a service week is cancelled, you may choose to scoop yourself at no charge, or leave the waste for collection at your next scheduled visit at double the standard weekly fee to account for the additional accumulation.
Skipping a Visit
You may skip a scheduled visit by notifying us at least 24 hours in advance at no charge. Skips with less than 24 hours' notice may be charged at the standard visit rate. Waste left from a skipped visit will be collected at your next scheduled service at double the standard weekly fee.
Pausing Service (Vacations)
If you and your pets will be away and you wish to pause service, please notify us in advance. If your dogs will remain at home with a sitter and waste will be collected by the sitter, you may cancel that week's service at no charge. If waste will remain for collection the following week, it will be billed at double the standard weekly fee. Pauses of more than 4 consecutive weeks may require a cleanup assessment and fee upon restart.
Section 09: Holidays and Weather
Holidays
If your scheduled service day falls on a holiday, your yard will be rescheduled within a three-day window of your original service day and we will notify you in advance. We reserve the right to schedule the week between Christmas and New Year's off, and one week for the national pooper scooper convention, which typically occurs in October. You may choose to scoop yourself those weeks at no charge, or leave the waste for collection at your next scheduled visit at double the standard weekly fee.
Weather
In the event of dangerous weather conditions β including extreme heat, heavy rain, flooding, or other unsafe surface conditions β service may be rescheduled or postponed at our discretion. We will notify you when possible. The same double-fee policy applies if waste is left over for the following week's collection.
Section 10: The 4 Spotless Guarantees
We stand behind our work. Every Spotless Poop Scoopers customer is protected by all four of our service guarantees:
β Guarantee 1: No Pile Left Behind
Find a missed pile within 24 hours of your service visit? We return for a 100% free re-sweep β no questions asked. Our penalty if we fail: 2 weeks of free service. (Note: This guarantee does not apply when missed waste is due to overgrown grass, excessive debris, or other yard conditions outside our control).
β Guarantee 2: Secure Gate Pledge
We provide photo proof that your gate was locked upon departure after every visit. Your security matters to us. Our penalty if we fail: That visit is free, plus a $50.00 account credit.
β Guarantee 3: Clean Departure
We haul all collected waste off-site β nothing left in your bins. Available on Spotless Signature and Spotless Supreme plans. Our penalty if we fail: A free re-clean plus a $25.00 account credit.
β Guarantee 4: Habit-Breaker
We apply repellent to protect your flower beds and deter your dog from returning to off-limits areas. If you see no change after 8 weeks of consistent application, we make it right. Available on Spotless Supreme plans only. Our penalty if we fail: Full refund of the Supreme tier premium for those 8 weeks.
Section 11: Reporting Changes
You agree to notify Spotless Poop Scoopers of any changes in the number of dogs or pets on your property. The following applies to changes in dog count:
- A visiting dog or pet that stays at your property for more than 48 hours during a service week will be charged the applicable per-dog weekly fee for that visit. Please notify us in advance whenever possible.
- If you acquire an additional permanent dog or pet and fail to report it within 2 weeks, we will charge an additional fee of $10.00 per unreported dog or pet found or observed on your property, plus the applicable per-dog weekly fee going forward.
Section 12: Consumer Reviews
Spotless Poop Scoopers values honest customer feedback. In accordance with the Consumer Review Fairness Act of 2016, we will not penalize customers for posting truthful reviews. However, we reserve the right to seek removal of reviews that:
- Contain confidential or private information about our employees or business operations;
- Are libelous, harassing, abusive, obscene, vulgar, or sexually explicit;
- Are discriminatory with respect to race, gender, sexuality, ethnicity, religion, or other protected characteristic;
- Are wholly unrelated to our services; or
- Are clearly false or materially misleading.
Section 13: Limitations and Exclusions
Our service is limited to pet waste removal from yard areas within your property boundary. We do not:
- Remove waste from inside your home or garage;
- Handle waste from livestock, poultry, or wildlife;
- Perform service in areas that are unsafe, flooded, or inaccessible; or
- Haul away large accumulations from properties not regularly serviced without a prior cleanup assessment and fee agreement.
Spotless Poop Scoopers is not responsible for waste that cannot be located due to overgrown grass, excessive debris, or other yard conditions outside our control, and our No Pile Left Behind Guarantee does not apply when these conditions exist.
Diarrhea and Loose Stools
Collection of diarrhea or other loose stools requires additional time for scraping, tool cleaning, and disinfection, and may indicate a health concern for your pet. We will collect loose stools at an additional per-visit fee, which will be disclosed to you at the time of service or upon request. Alternatively, you may choose to allow that waste to dry during the current service week and have it collected at no additional fee at the following scheduled visit.
Section 14: Customer Responsibilities
As a Spotless Poop Scoopers customer, you agree to:
- Provide accurate information about your property, yard size, and number of dogs at sign-up and whenever changes occur;
- Ensure yard access on your scheduled service days, including unlocked gates free of obstruction;
- Keep all pets secured during service visits;
- Maintain grass height and clear debris so that waste is locatable;
- Turn off sprinklers on your scheduled service day;
- Maintain current vaccination records for all dogs on your property;
- Notify us promptly of any changes to your dogs, yard access, or service requirements;
- Maintain a valid payment method on file at all times; and
- Treat our technicians with courtesy and respect.
Section 15: Suspension and Termination of Service
Spotless Poop Scoopers reserves the right to deny, suspend, or terminate service to any customer at any time, for any reason or no reason, at our sole discretion. Reasons may include but are not limited to:
- Safety concerns, including aggressive animals or unsafe property conditions;
- Non-payment, repeated late payment, or declined cards;
- Repeated access issues that prevent service from being performed;
- Abusive, threatening, or harassing behavior toward our staff; or
- Any other circumstance we determine makes continued service impractical or unsuitable.
Except in cases involving immediate safety concerns β where service may be suspended without prior notice β we will provide at least 7 days' written notice of termination. You will not be charged for any service visits scheduled after the effective termination date.
Section 16: Liability
Spotless Poop Scoopers carries general liability insurance and agrees to provide services in a reliable and trustworthy manner. In consideration of these services, the customer holds Spotless Poop Scoopers and its employees harmless from and expressly waives all claims, except those arising from gross negligence on the part of Spotless Poop Scoopers.
We are not liable for:
- Pre-existing damage to gates, fences, landscaping, or yard features;
- Damage caused by weather, acts of nature, or third parties;
- Pet injury or illness unrelated to a direct act of our technicians;
- Waste not collected due to yard conditions outside our control (overgrown grass, debris, standing water); or
- Any indirect, consequential, or incidental damages.
Claims for direct property damage caused by our technicians must be reported to us within 24 hours of the service visit in question. Our total liability for any single claim shall not exceed the amount paid for the service visit at issue.
Nothing in this Agreement limits any rights you may have under California consumer protection law.
Section 17: Dispute Resolution
Informal Resolution First
We are committed to resolving concerns quickly and fairly. Before initiating any formal legal action, you agree to contact Spotless Poop Scoopers directly to describe your concern and give us a reasonable opportunity to resolve it. Formal Dispute Process
If a dispute cannot be resolved informally within 30 days of written notice, either party may pursue their legal remedies in the appropriate court. Any suit or legal proceeding arising out of or relating to this Agreement or our services shall be brought exclusively in the state or federal courts located in Fresno County, California. Both parties consent to the personal jurisdiction of those courts.
This Agreement does not require binding arbitration, and you retain the right to pursue claims in court, including in small claims court where the amount in dispute qualifies.
California Small Claims Court
For disputes involving amounts within the small claims court limit under California law, you may file a claim in Fresno County Small Claims Court without an attorney. We encourage customers to use this option for straightforward billing or service disputes.
Section 18: Changes to This Agreement
We may update this Service Agreement from time to time. We will notify you of material changes via email or SMS (if applicable) at least 14 days before they take effect. Continued use of our services after the notice period constitutes your acceptance of the updated Agreement. The current version of this Agreement is always available on our website.
Section 19: Governing Law
This Service Agreement is governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be resolved exclusively in the state or federal courts located in Fresno County, California.
